  • As of the 7th January, we have won the right to a formal judicial review, with a High Court hearing due to take place on 21st April 2016.
  • New crowdfunding target of £5000 is now needed to help me cover the costs of the now agreed judicial review to protect the Severn Estuary.

What this case is about

I am one of some 100 local residents living near the Severn Estuary in the Forest of Dean, who are concerned about the proliferation of single wind turbines being installed in the Severn Estuary, damaging the lovely rural landscape. Whilst I, and many others, accept the benefits of wind turbines in the right place, a series of single turbines, backed by the same developer, all within the same rural setting, is totally unjustified. It is creating a wind farm landscape by stealth.

We also observe that the Severn Estuary is a sensitive animal and bird breeding area. (See e.g. Wikipedia entry on the Severn Estuary, section on Conservation and SSSI status; and the Severn Estuary Partnership website.) The RSPB has also expressed its concern about the impact of the several wind turbine schemes proposed for the upper Severn area:

Together these have the potential to cause significant disturbance to waterbirds using the Severn Estuary Special Protection (SPA) and Ramsar Site…We are particular concerned about any impacts on curlew, since this is now a globally ‘near threatened species’ under IUCN criteria for which the UK holds special responsibility to maintain its breeding and wintering populations.

Protecting the Severn Estuary

For over 2000 years, the Severn Estuary has been a rural landscape and natural habitat for wildlife. 2 single wind turbines have been granted planning permission and at least 5 additional single wind turbines are seeking planning permission within a 10 mile stretch of the estuary all supported by the same developer, the Resilience Centre.

 

In the present case, the planning applicant’s wife, Councillor Maria Edwards, was elected to the Council and appointed to the planning committee whilst the planning application was under consideration.

A clear majority of the affected local community are now firmly opposed to this development. In accordance with the Planning Practice Guidance, the community’s valid planning objections should have been taken into account and the Council should have rejected the Severndale application as the developer was not able to address the objections. Instead, the councillors placed undue weight and consideration to unspecified ‘community benefits’ (financed by the proceeds of the turbine).

The Senior Planning Case Officer on two occasions advised the Planning Committee that they should not take into account these ‘community benefits’ and should refuse planning permission, but the Councillors ignored this completely in reaching their decision citing the ‘community benefits’ as one of the main reasons for granting planning permission. Financial considerations which are not linked to the proposed development should be ignored in determining planning applications in accordance with law and government guidelines, as to take them into account would allow applicants to effectively ‘buy’ a planning permission. After applying to the High Court to review this decision and to quash it to prevent further unjustifiable damage being inflicted on the landscape as a result of this decision, I have now won the right to a formal judicial review.

A short timeline of my case

  • Planning application submitted in March 2015.
  • Local residents were notified of the planning application in late April 2015 with response required by end of May. The applicant submitted additional information in June 2015 following receipt of objections from statutory consultees, the Council’s officers, the Parish Council and local residents who opposed the scheme for a wide variety of reasons including harm to wildlife, the landscape and the setting of a number of heritage assets.
  • The application was due to be considered by the planning committee in July 2015, but due to last minute submissions by the applicant following receipt of the planning officer’s report which recommended refusing planning permission, consideration of the application was postponed to September.
  • The applicant then realised that they might miss the deadline to guarantee the higher rate Feed in Tariff and for this reason alone asked for the application to be heard in August. Despite protests from Peter Wright and others, the FODDC Planning Manager agreed to this expedition. Critically the Planning Officer who had recommended it be refused was then on holiday so could not attend this meeting.
  • On 11th August, contrary to the advice of the Planning Officer and contrary to the objections of the Parish Council and the majority of local residents, the councillors decided to grant planning permission to the proposal.
  • The local residents then asked the Secretary of State to “call in” the application and make a decision himself in mid-August. After some 5 weeks, on 29th September 2015 the Secretary of State decided not to call in the application for his own determination and the application was formally granted planning permission by the Council on 30th September 2015 – the very last date on which a developer could apply to secure the current higher Feed in tariffs.
  • The application for judicial review was filed on 11 November 2015, and was granted on the 7th January 2016.
  • Hearing date is set for 21st April 2016.

Why should people help?

The Planning Application was approved in clear conflict with the law regarding financial considerations being taken into account when considering planning applications, contrary to the recently implemented amendments to the Planning Practice Guidance on wind turbines which give the local community the ‘final say’ and contrary to Government Guidance regarding the weight to be attached to purported community benefits.

The Councillors in this case appear to have allowed themselves, in making their decision, to be unduly influenced by the developer’s promise to finance community benefits and may do so again in other cases unless I act now. They have effectively allowed the developer to buy this planning permission and they must not be allowed to buy further developments.

If successful, this challenge will ensure that no other Council can act with such impunity in the face of the overwhelming views of the local community and in breach of planning guidelines regarding alleged community benefits. In the Forest of Dean, there are at least 5 similar planning applications pending consideration and no doubt potentially hundreds across the UK. If I am successful, clear guidance will be available for other local communities to ensure that their Councils act fairly, with due regard to their constituents’ views.

What am I raising and what is it for?

Now that a formal judicial review has been granted, I am fundraising to cover the costs. Specifically, I am raising £5000 to match my own funds in order to cover £10,000 in additional costs. This will ensure that I have sufficient funding to enable me to proceed.

Apologies for the late arrival of this email after our meeting on the 10th, amongst other things I have had phone and internet problems so hopefully all is now back on track.
Thanks to those who came to Little Wibdon and to those of you who were in touch by email or have enquired about the topics under discussion. As I hope everyone knows, we have our Judicial Review hearing for April 21st (as long as the courts keep to their timetable) and some of us are intending to attend this event.  There was a suggestion to investigate a minibus, since Buxton’s commented that some support for the event demonstrates commitment from those who have asked for the JR, and I will look into the cost of hiring a minibus and let you know.
We all felt the need to continue to be proactive and it was suggested we send Mark Harper our concerns and thoughts just to let him and ‘others’ know we are not going away and will continue this fight no matter what.  I have checked his email address and found it different from last time I used it  –
I haven’t used it yet and would be grateful if anyone has difficulty using it- please would you let me know. Last time several of us tried to contact him we had problems so it’s helpful to know if the same happens again.
Some suggested areas which you might wish to make him aware of could include

                  The affected community has not been defined for this application and he should put pressure on the FODDC to identify this.
                  The Parish Council continue to be opposed and deserve his support – after all they should be considered part of the affected community.
                  The Crowd Justice site helps identify the local concern about the Severndale Wind Turbine.
 
                  The Allocation Plan which includes suitable sites for renewables does not identify wind turbines specifically and these are industrial structures – re Alvington.
                  The Allocation Plan now being considered by an inspector was considered by the FODDC last summer and Government policy has significantly changed.
                  We were dealt with unfairly by our councillors since their reason for passing the application is now for Judicial Review.
                  A significant number of the people in the locality do not want this turbine.
                  Government cannot afford the subsidies originally offered for wind turbines and in these times of austerity these grants and subsidies should be stopped.

The portfolio group at the time discounted a bespoke policy on wind turbines. Ultimately a new policy on renewable energy was formulated and has been included in the Council’s Allocations Plan Submission Draft August 2015 Please see Policy AP.2 on page 22 of the document.

Should we be contacting the Inspector with our comments about wind turbines? Thoughts on this would be useful. 
So – please would you find the time to write to Mark Harper using any of the suggested areas plus your own ideas.  It doesn’t matter how short but if he could receive them between now and March 11th (3 weeks) it would make a significant impact before Easter and before JR in April.

The Government confirmed it was “looking carefully” at a wind industry proposal to continue public financial support for new turbines, despite a manifesto pledge to halt expansion.

Critics described the proposal as a con, and said the Conservatives’ policy had been “crystal clear” that the subsidies would stop.

Under the plan, households would still be forced to pay millions of pounds on their energy bills to fund new wind farms – but the payments would no longer be defined as subsidies.

Opponents called the plan ?outrageous?

The wind industry’s plan hinges on the fact that no new power plants are commercially viable to build at the moment without extra financial support from bill-payers.

If wind farms can be built at lower cost to consumers than alternatives, such as new gas plants, then payments to fund them should no longer be classed as “subsidy”, the industry argues.

Andrea Leadsom, the energy minister, admitted that the proposal for so-called “subsidy-free” contracts would not in fact be “cost free” for bill-payers, but said the Government was “listening carefully to industry on how it can be delivered”.

Opponents called the plan “outrageous” and said that the proposals under consideration would still constitute subsidies.

Owen Paterson, the Tory MP and former environment secretary, said: “Hard-working energy consumers will not be conned by a change in name. The Conservative manifesto was crystal clear that public subsidies for onshore wind will stop.

“There is absolutely no place for subsidising wind – a failed medieval technology which during the coldest day of the year so far produced only 0.75 per cent of the electricity load.”

The Conservatives pledged in their 2015 manifesto to “halt the spread of onshore wind farms” and vowed to “end any new public subsidy” for the turbines.

More than 5,000 wind turbines have so far been built onshore in the UK under efforts to hit renewable energy and climate change targets.

Consumers are already estimated to pay in excess of £800 million a year in subsidies for the turbines, adding about £10 to an annual household energy bill.

David Cameron has said that Britain does not “need to have more of these subsidised onshore”.

But the proposal being considered by the Department of Energy and Climate Change (DECC) would see onshore wind farms continue to qualify for an existing subsidy scheme that guarantees developers a fixed price for electricity generated.

The most recent onshore wind farm contracts awarded under the scheme, early last year, were at prices of about £80 per megawatt hour (MWh) – more than double current market prices of about £35/MWh. Consumers will fund the difference through green levies on their energy bills.

Under the proposals being looked at by DECC, prices of between £60/MWh and £80/MWh would be regarded as “subsidy-free” by 2020.

John Constable, of the Renewable Energy Foundation, a group critical of renewable energy costs, said it would be “outrageous” to regard the proposal DECC was considering as “subsidy free”. “It is just spin doctor stuff, it’s playing with words,” he said.

Glyn Davies, the Tory MP, a member of the energy select committee, said: “I don’t think we should be introducing mechanisms that continue with subsidy – just to say there’s no subsidy when there actually is.”

He said he would be “very concerned” if ministers continued payouts to new onshore wind farms.

Fellow Tory Peter Lilley said the wind industry’s proposal “wouldn’t be subsidy-free” and that wind farms should not receive the same support as gas plants, because the power they produced was not reliable and was therefore worth less.

Mr Paterson added: “If we must support energy, we should help develop combined heat and power which increases efficiency from 50 per cent to 80 per cent or we should develop new technologies which actually work.”

A DECC source insisted energy secretary Amber Rudd was “crystal clear that the manifesto commitment to end new public subsidies for onshore wind and give local people the final say is delivered to the letter”.

“Any idea that doesn’t do this is simply not going to get the green light,” the source said.

The influential think-tank Policy Exchange has said that “subsidy-free” contracts should be offered to support the construction of new onshore wind farms in Scotland and Wales, as well as replacing old turbines with new, far bigger ones.

Maf Smith, deputy chief executive of Renewable UK, said it would be “anti-competitive” to bar any technology from competing for the financial support being offered for new power plants.

A DECC spokesman said: “There is no change to our commitment to end new onshore wind subsidies. Our actions have shown that we will be tough on subsidies, in order to keep bills down for our families and businesses.”

Dear members of the Zoning Board of Appeals,

I am submitting this letter for your consideration as you contemplate the matter of whether or not to issue a permit for the wind turbines. In way of introduction I am a psychiatric physician and Falmouth resident since 1970. This year I will have been practicing medical psychiatry for 49(forty nine) years. Consultation/liaison psychiatry has been my focus. This means sorting out diagnostic questions about intertwined medical/psychiatric illnesses, the most difficult diagnostic questions in medicine, whether in a general hospital, locked psychiatric unit or maximum security prison. I will be brief and to the point as I explain why I urge you to deny a permit for the Falmouth wind turbines.

1. The human nervous system is the most sensitive instrument available to date for evaluating the impact of the Falmouth wind turbines on residents who live close to them. The ONLY experts in the discussion are the people who are sensing the sound, vibrations, pressure waves, etc emitted by the turbines. There is no one more “expert” than these people. No so called expert has either equipment nor information more accurate and sensitive than the affected residents’ nervous systems. NO instruments more sensitive than people have been invented! Others who claim to be experts are peddling smoke and mirrors in an effort to invalidate and discredit the affected residents. Also, other turbines in other places are not the issue, since local topography must be considered. The impact of the Falmouth wind turbines on Falmouth residents who live nearby is all that is relevant. I believe they are definitely hurting people living near them and encourage you to NOT permit the turbines, now, long after they were constructed illegally.

Over the past few years I have spent significant amounts of time in the vicinity of the turbines in an effort to understand what the affected residents are describing. My findings were unanticipated and surprised me. I was not prepared for the intensity and intrusiveness of both sound and vibration felt consistently and repeatedly throughout the years of my studying the phenomena on location. I recall my introduction to the sound of “low flying jet airplanes” overhead loud enough to interrupt conversation; and, of course, the “planes” kept coming one after another in endless sequence with each rotation of a turbine blade!!! I was searching the sky looking for the aircraft when my eye caught the turbine blades , and then it all made sense, of course; no aircraft in sight, only Wind I blades. Later on, as I leaned against one of the houses in the neighborhood, I felt an unusual sensation best described as compression, coupled with a rhythmic vibration felt through my feet. Anyone who discredits, demeans and calls the affected turbine neighbors “crazy” hasn’t done his or her homework, in addition to being mean spirited. The homework is not difficult: stand in the turbine neighborhood for as long as I have and feel what happens to you. The sensations are real and disturbing. It is totally clear to me that I could not live within the radius of influence of the turbines, and I have no idea how the neighbors who are in the turbine area can sustain a healthy quality of life. Against the backdrop of what I have learned from personal experience with the effect of the turbines I see the Town of Falmouth trying to crush the residents impacted by the turbines.

2. Let’s move on to sleep disturbance and sleep deprivation which is the bedrock of the area of medicine in which I have worked for 49 years! Sleep disturbance is not a trivial matter, even though it has been trivialized by the Falmouth Board of Health. Children with inadequate sleep perform poorly academically, emotionally and physically(they present a higher than normal incidence of physical illnesses). For ANYONE (athletes, truck drivers, ship operators, aircraft pilots, lawyers and physicians, et al) sleep deprived and fatigued, errors in judgement increase, accident rates increase, in addition to physical and emotional symptoms and cognitive impairment. In the world of medical observation all varieties of illnesses are destabilized secondary to inadequate sleep: diabetic blood sugars become labile and erratic, cardiac rhythms become irregular, migraines erupt and increase in intensity, tissue healing is retarded, to list a few across the entire range of physical illnesses. Psychiatric problems intensify as the sleep deprived brain decompensates; mood disorders become more extreme and psychotic signs and symptoms more severe.

People with no previously identified psychiatric illness are destabilized by sleep deprivation. Sleep deprivation experiments have repeatedly been terminated because test subjects become psychotic; they begin to hallucinate auditory and visual phenomena. They develop paranoid delusions. This all happens in the “normal” brain. Sleep deprivation has been used as an effective means of torture and a technique for extracting confessions.

I could work my way through 49 years of observing sleep disturbances and deprivation, but that is more than the scope of this letter. I am writing because I have witnessed Town of Falmouth officials and members of other boards trivialize symptom reports from people who are stalwart residents of the Town of Falmouth. I have witnessed attempts by town officials and other board members to discredit people whom I believe the wind turbines are hurting. Furthermore, all the Wind I neighbors I have examined are passionate about the need for sustainable energy in an effort to reduce fossil fuel dependence.

I see no honest way for the ZBA to issue a permit for the Falmouth wind turbines. Basically, as I see it, the town installed commercial wind generating power plants in a residential neighborhood. Inappropriately permitting the illegally sited turbines will continue to impair the development of well designed and properly sited wind turbines which are vitally needed.

EUROPE: Questions remain over who pays for the additional inspections required following the failure of a Bonus turbine at the Danish Paludan Flaks offshore project in November.

On 28 November 2015, one of ten Bonus Energy 2.3MW turbines at the 14-year-old Paludan Flaks offshore wind project near the Danish island of Samso suffered a catastrophic failure; the nacelle and blades broke off and fell into the sea.

Catastrophic failure is widely defined as the complete, sudden, often unexpected breakdown in a machine or other system. This winter, there have been four such events reported across the wind industry.

With regular wind turbine service and maintenance and the possibility of sophisticated condition monitoring, how is such an embarrassing failure — appearing as it seems out of the blue — still possible?

At Paludan Flaks, the answer is still not clear.

The project owners — a group of municipalites and investors — are still negotiating over the consequences with German industry giant Siemens, which has the service contract for the Paludan Flak wind farm.

Siemens acquired Danish turbine manufacturer Bonus Energy in 2004, and the service contracts came with it.

A spokesman for Paludan Flaks told Windpower Monthly in early February: “I cannot comment on the situation because Siemens insisted on a non-disclosure agreement before it would begin negotiations with us on how the problems at the wind farm will be solved.”

For its part, Siemens declined to comment on who will pay for the lost electricity output of the destroyed turbine.

Whether the machine will be replaced, and whether the tower can be re-used “is currently under clarification together with the customer”, the German manufacturer said.

The remaining nine Bonus 2.3MW turbines at Paludan Flaks were inspected shortly after the incident, found to have no defects, and have been producing power since, Siemens added.

Siemens and the Secretariat for the Danish Wind Turbine Certification Scheme agreed that regular checks on the remaining turbines will be performed once a month until further notice, in line with the technical certification scheme for design, manufacture, installation, maintenance and service of wind turbines. But who pays for the extra inspections is also not clear.

Investigations ongoing

Technical investigations are still under way into the root cause of the failure at Paludan Flak.

“Investigations so far have concluded that the tower top flange welding-geometry is not optimal, but it cannot be ruled out that the turbine was affected by abnormal load conditions, causing the crack in the tower to occur,” Siemens said in early February.

An issue with the top flange on Bonus machines was first identified in 2003 at an undislosed site with extremely high and turbulent wind conditions.

This led, “after a thorough technical assessment”, to a general update of the design of the top-flange configuration for new installations, as well as a retrofit programme for already installed turbines, depending on site-specific assessments.

In this respect, the Paludan Flaks wind farm was assessed as not being affected, Siemens said.

But after a crack in the tower top flange weld of a 1.3MW Bonus turbine was identified in January 2016, Siemens re-assessed the 2003 retrofit criteria using a more advanced calculation model. This assessment is still on going, the company added.

Under the review, Siemens launched an inspection campaign of about 750 Bonus turbines to ensure the potential risk is controlled, the company continued, without divulging the locations of these turbines.

The tower top flange is inspected visually by the local service staff operating the turbines, the company said. “It is not a major task and can be done quickly,” said a spokeswoman for Siemens, declining to comment on the cost involved.

Similar problems

Why the company did not react earlier — considering the small outlay in time and effort for inspection, and experience with issues of the tower top flange retrofit dating back as far as 2003 — to amend other turbines with the same problem and prevent such potentially image-damaging catastrophic failure is not clear.

An incident at the Smola wind farm in Norway also gave the company some experience in the issues.

In October 2011, Statkraft technicians who carried out operations and maintenance work at the project noted a noise problem at Smola phase 1, comprising 20 2MW Bonus machines commissioned in 2002.

During additional inspections they discovered a crack in the tower top of one turbine and closed it down. Five of the other turbines were also found to be badly damaged and had to be repaired.

The repairs were carried out by Statkraft in cooperation with Siemens, Statkraft’s vice president of communications for wind power and technologies, Torbjorn Steen, said in February.

Why the Smola incident did not trigger wider action by Siemens at that time is not clear.

Also in November 2015, the rotor fell off a Repower MD77-1500kW turbine in France. And in December, a Vestas V112-3MW turbine collapsed in Sweden, and a Suzlon S95-2.1MW turbine tower collapsed in Brazil.

None of the incidents resulted in injury.

Hi,

there would seem to be no clear policy in Government regarding wind turbines as decisions emanating from Greg Clark’s department are so varied, each from another that it would seem Justice is not even a consideration in terms o0f a level playing field.

Consider the progress of the Stroat Wind turbine application where for no apparent reason our Tory MP, Chief Whip for the party with the aim to ensure Government policy is carried out not only declined to intervene in the planning process to seek Government policy was carried out but failed even to put our case to Greg Clark in detail siting the view I QUOTE:

It is not my responsibility to intervene even when Councillors make crap decisions“!

A brief read of the FoDDC Planning Committee’s deliberations when considered with Mark Harper MP’s failure to seek justice and the utter failure of the Council to represent the interests of the effected communioty or the Parish Council leaves a very bad taste in the mouth and seems perversde and vexatious despite the denials that the Councillor who made the application, Maria Edfwards, was councillor on FoDDC and as a first termer was coincidentally on the planning committee!

 

You will have noted that when the High Court reviewed our application they too felt the process was amiss and have granted the right of Judicial Review to an applicant from the Parish Peter Wright.

 

It is always a relief to know ones personal judgement is not out of order, though there is never a wrong time to do the right thing it is pleasing to note that the High Court considers the matter to be worth of investigation.

 

Clearly Justice has not been seen to be done in the light of this application, from the viewpoint of the overwhellming majority of the effected community!

Clark refuses four-turbine Somerset wind farm

The communities secretary has refused plans for a four-turbine wind farm in Somerset after concluding that, amongst other factors weighing against the proposal, it would be contrary to local heritage-related planning policy.

Mendip District Council had refused to grant planning permission for the erection of four wind turbines with a maximum blade tip height of up to 80 metres, together with a substation and associated works including two temporary anemometer masts for a period of up to 12 months.

The development was proposed for a site adjacent to Torr Works, Somerset.

Following an appeal, a planning inspector recommended that a split decision be issued, with the appeal allowed and planning permission granted insofar as it related to the proposed temporary anemometer masts, but refused insofar as it related to the proposed wind turbines and other associated development.

The decision was recovered by Greg Clark because it related to a renewable energy development.

A decision letter said that he agreed with the inspector’s conclusions.

The letter said that Clark concluded that the application would conflict with the council’s local plan policy DP3 which relates to heritage conservation.

“As the achievement of sustainable development is central to the local plan and the National Planning Policy Framework, the proposed wind turbines would not therefore accord with the development plan when read as a whole”, the letter said.

The letter said that Clark attached “considerable weight” to the development’s economic benefits alongside its contribution to cutting greenhouse gas emissions and the supply of renewable energy.

However, it added that, weighing against these benefits “is the totality of the harm to the setting of grade II and grade II* listed designated heritage assets. Like the Inspector, the Secretary of State has had special regard to the desirability of preserving the settings of the listed buildings … He attributes considerable weight to this harm.”

In addition, the letter added that the application did not meet the provisions set out in theJune 2015 written ministerial statement (WMS).

“As the secretary of state has found a number of harms arising from the proposal he concludes that the planning impacts identified by the affected communities have not been addressed, the proposed scheme would not meet the requirements of the transitional arrangements set out in the WMS; and the secretary of state gives significant weight to this non-compliance.”

As a result of everyone keeping each other up to date, we understand the Parish Council have the  pending ‘Severndale Wind Turbine Judicial Review‘ on the agenda for this Wednesday evening’s council meeting ( 27-Jan-2016)
Please try to attend the meeting to demonstrate that there is still a ground swell of opinion against this futile and inefficient Wind Turbine which is intrusive and damaging to the ecology both locally and globally. You can help show that common sense and concern for the environment is not going away and we hope our local councillors will continue to represent us and fight to oppose this scam with us.

Strange when you think that after the last 29 ice ages that science claims to have occurred there has been very significant Global Warming.

Since the self same grouping of science alarmists, in order to perpetuate their income and various grants, presumably, had been warning of an impending ice age in the 1970s and early 1980s – were there any plausible facts or undisputed evidence to support the IPCC reports fanciful claims and alarmism, perhaps we should today be thanking mankind for his prodigious power in changing climate to avoid the ice age we were threatened with!

We are threatened by these same scientists with the extinction of polar bears – fancy that! When I was a child we were taught that the polar bear was threatened as there were only between 7 & 10,000 on the planet – their extinction is no closer now than then as estimates claim there are now around 30,000 in the wild alone!

To further personalise the issue I live a few 100 yard north of the Severn Estuary and Global Warming has altered this area hugely as during the last ice age it was ONE MILE deep in ice, Climate Change clearly has some merits ;-))

Leonardo DiCaprio has made an error of Titanic proportions by mouthing off at theWorld Economic Forum in Davos. The Hollywood A-lister sternly warned the not so great and not so good that “our planet cannot be saved unless we leave fossil fuels in the ground where they belong”. Noble sentiments indeed, intended to force business leaders to take a Revolutionary Road to a lower emissions planet…

He went on to rail at the “corporate greed” of “entities with a financial interest in preserving this destructive system”, admirably lambasting the Wolves of Wall StreetOf course he didn’t mention that he’s earned a cool $250 million in his career, greedily demanding $25 million for one film alone. Isn’t that more than a Blood Diamond is worth?

Unfortunately poor Leo seems to have something of a sweet tooth when it comes to plane travel, in particular private jets. Accordingly the actor regularly jets around the world, even managing to use the services of one of Sony’s jets six times in six weeksWell who can blame him – he wanted to get to The Beach at his private Shutter Island, so he hopped on the nearest available jet and Departed. Indeed Guido wonders how his colleagues in the film industry even keep up with globetrotting Leo – Catch Him If You Can, Scorcese.

This all came as quite a shock to Guido, who remembers him saying back in 2007 that he’d swapped the jetsetting for hybrid cars and solar panels. In the light of such staggering hypocrisy, some might say he’s The Great Twatsby…

JUDGE RULES MCDONNELL IRRELEVANT

A judge has refused Shadow Chancellor John McDonnell’s attempt to give evidence at the trial of 13 climate protesters accused of blockading a Heathrow runway. Plane Stupid supporters are alleged to have cut a hole in a fence at the airport before chaining themselves to railings on the north runway in July 2015. They apparently even wore nappies so they didn’t have to break the strike to nip to the loo… 

McDonnell wanted to give evidence defending “the benefits of direct action”, yet District Judge Deborah Wright deemed what he had to say irrelevant:

“It (his witness statement) gives an opinion about the debate around the expansion of Heathrow and talks about the benefits of direct action, which he says may cause short term inconvenience. In order to allow his evidence to be given I have to be able to say that it is relevant. I am therefore not going to allow Mr McDonnell to give give evidence.”

That’s the same direct action advocate John McDonnell who previously endorsed spitting in your boss’ tea. What is it with Labour’s top two and defending alleged criminals in court?

RENEWABLE SUBSIDY JUNKIES DEAD IN FIVE YEARS

The Indy have published some analysis on the fate of the UK’s renewable energy industry following the announcement of cuts to subsidy junkies. The research predicts that despite 2015 being a record year for renewable energy production, the industry is set to “fall off a cliff” as a result of withdrawn subsidies. This trend will continue until after 2020, when “the new renewables infrastructure will collapse to almost nothing because of a lack of investment”.

So it’s not the best time for the International Renewable Energy Agency to publish a report boasting that a global 36% renewable energy share is in reach, and will provide half the reduction in emissions required to hit the Paris summit targets. This is the renewable industry’s problem summed up. It needs shed-loads of taxpayer cash to survive, and when the subsidies are taken away it goes to the wall…

ARCTIC “EXPERT” PREDICTED SEA ICE GONE BY LAST YEAR

Guido has unearthed a gem from the FT’s archive. Back in 2013 Peter Wadhams toldthe FT that Arctic sea ice would disappear in the summer of 2016 Wadhams, who is head of the Polar Ocean Physics Group at Cambridge, claimed that we would see “the Arctic death spital”, going on to state:

““It could even be this year or next year but not later than 2015 there won’t be any ice in the Arctic in the summer”.

Unfortunately for Peter, who describes himself as the leading authority on the Arctic sea ice, it didn’t disappear last summer, and is in fact in significantly better shape than when he made the prediction back in 2012. Last year the minimum Arctic sea ice extent was 4.41 million square kilometres, compared to 3.39 million square kilometres in 2012. How inconvenient…

Peter of course predicted in The Guardian that the collapse in sea ice would trigger a significant increase in global warming:

“As the sea ice retreats in summer the ocean warms up (to 7C in 2011) and this warms the seabed too. The continental shelves of the Arctic are composed of offshore permafrost, frozen sediment left over from the last ice age. As the water warms the permafrost melts and releases huge quantities of trapped methane, a very powerful greenhouse gas so this will give a big boost to global warming.”

Again such predictions were wide of the mark, with no such vast increases having occurred in global warming since. Yet again the science gets in the way of Wadham’s overblown predictions…

This isn’t the first time the Cambridge professor has made a particularly outlandish statement however, having previously claimed that three climate change scientists studying the ice caps were assassinated to prevent the their explosive research being revealed. Keep drinking the kool-aid professor. Maybe next year…

GUARDIAN GOES NUCLEAR ON RENEWABLES “DENIALISTS”

The Guardian have decided to expand their admirably broad definition of what constitutes climate-change “denialism” to include those who doubt the viability of renewables sector for large scale energy production, instead preferring nuclear power. In an article released yesterday, Naomi Oreskes argues that a “new, strange form of denial that has appeared on the landscape of late, one that says that renewable sources can’t meet our energy needs”. Perhaps sensing the weakness in her argument she goes on to concede that some proponents of this new denialism are climate scientists themselves:

Oddly, some of these voices include climate scientists, who insist that we must now turn to wholesale expansion of nuclear power. Just this past week, as negotiators were closing in on the Paris agreement, four climate scientists held an off-site session insisting that the only way we can solve the coupled climate/energy problem is with a massive and immediate expansion of nuclear power. More than that, they are blaming environmentalists, suggesting that the opposition to nuclear power stands between all of us and a two-degree world.

Climate scientists just aren’t anti-industrial enough for The Guardian…

The bill was passed by 298 votes to 261, and will allow fracking 1200 meters below national parks, areas of natural beauty and world heritage sites. The victory will be welcome for pro-fracking Climate Secretary Amber Rudd, coming after MPs previously pledged an “outright ban” on fracking in national parks in January. Should give the anti-fracking lobby something to think about…

Readers will be well aware of the stench coming from the rotten borough of Sutton, where the LibDem council gave a £1 million discount to a company of which neighbouring MP Tom Brake is a trustee and unpaid director. Ecolocalan environmental charity based in the borough, won its £600,000 bid for the historic local Lodge building, despite the council’s own valuations estimating it to be worth £1.5-1.7 million. That’s just the tip of the iceberg…

Before Ecolocal was awarded the discount, the eco-charity was oddly quiet about controversial plans to build a 300,000 tonne a year incinerator in the borough. Incinerator operators Viridor will be allowed to burn rubbish for 25 years with a taxpayer-funded contract worth £1 billion. Ecolocal is the premier environmental organisation in the borough, yet they were strangely silent. Surely they would have something to say? 

The Brake-linked charity says its primary aim is to “help people move toward more pro-environmental behaviours”, yet had no comment about plans to build one of London’s largest waste incinerators inside their borough. Coincidentally they were then awarded a £1 million discount by the LibDem council, voted through by two of Brake’s own staff. Local councillor Nick Mattey says:

“Ecolocal would commit financial suicide if they criticised any element of the LibDem’s ‘environmental policy’. If the LibDems suggested that setting light to Battersea dogs home was green Ecolocal would stay mute.”

GLOBAL WARMING VINDICATED AS OXFORD TEMPERATURES SKYROCKET

Guido is sorry to report that one of the world’s oldest meteorological stations has become somewhat neglected as of late. The Radcliffe Meteorological Station in Oxford has provided data since 1767 and has historically formed part of the Central England Temperature Record, often cited as the longest instrumental record of temperature in the world“. 

Unfortunately it appears that the climate scientists of today don’t hold the station in such high esteem, having decided to plonk a ventilator for a heated tent a few yards away from the highly sensitive temperature recording devices. Oops…

The Oxford School of Geography and the Environment, which oversees the station, states on its website that the centre can boast an “almost unparalleled record unbroken since 1815″, and that it sees “no reason why the Station should not continue to provide valuable data for at least the next two hundred years”. Unless of course the Bullingdon need another heated tent to throw a soiree, in which case temperatures may rise…

CRACK OPEN A BOTTLE: GLOBAL WARMING GOOD FOR CHAMPAGNE

Readers will be well aware that the French establishment is going to great lengths to make sure that the upcoming Paris Climate Summit is a resounding success. Cars arebeing banned, climate-sceptic weatherman are being sacked, and tinpot Bolivian socialists are being cosied up to with reckless abandon. It is in this climate that the champagne industry has rather sheepishly revealed that, actually, global warming has been terrific for the production of bubbly.

Pierre-Emmanuel Tattinger, director of the eponymous champagne house, had this to say about the effect of climate change on his business:

“The impact of global warming in the Champagne region is that for the last two decades we have had hardly any major frosts. We have had much larger harvests and we have had largely excellent vintages for the last 20 years. So in the Champagne region, it’s positive. Even though I think globally climate change is a top priority, as far as I’m concerned global warming is the Third World War”

Guido can understand why he closed his remarks by warning about the impending climate apocalypse. It’s a wise idea to keep Mumm in the current political climate in France…

Why has climate change been so good for bubbly? Well the Champagne region in north-eastern France has seen a 1.2 degrees centigrade increase in temperature over the past 30 years, which has handily served to decrease frost damage, thus allowing for bigger harvests. It has also added 1% to the level of alcohol and reduced it’s acidity. Yes dear reader you did read that correctly: global warming is not only giving us more champagne, it’s also making it stronger and tastier.

Even the climate nuts have conceded that climate change is helping champagne producers. Just so everyone is Cristal clear on this: global warming is good news for bubbly.

To recap, Agra won a €36,000 contract from the European Commission, and their consultancy sister arm won another €200,000 contract from the EU’s agriculture programme just last year. The claim that “we are funded and financed by absolutely nobody” is risible…

SEXY SOCIALIST MAYOR WANTS TO BAN DRIVING

Anne Hidalgo, Paris’s Socialist Mayor, has won a battle with the French government to restrict driving during periods of particularly heavy pollution. Following a spike in pollution on Monday, alternate driving days for cars with odd and even number registration plates have been introduced for when air quality falls below a certain level. The move has been pushed through in the run-up to the Paris Climate Summitin December, with officials clearly anxious to quell any obstacles to the event running smoothly. However Guido’s not so sure that the French, known for theirnotoriously blasé attitude to transport regulation, will pay the blindest bit of notice to Ms. Hidalgo’s imperative. Are the police supposed to check the numberplate of every single car?

Hidalgo is known for her hard line stance towards the use of cars in the capital, even banning them from the city’s streets for a day earlier this year, and has previously stated that she aims to make the Seine so clean that by 2024 Parisians can bathe in it. So cars will be gone, but at least they can swim to work…

France’s most popular weatherman Philippe Verdier has confirmed in a video that he has been sacked, having been suspended in mid-October for criticising top climate scientists in his new book, Climate Investigation. Verdier, who used to work for state-owned France 2, used his book to claim that publicly-funded climate change scientists have been “manipulated” and “politicized”, and that theIntergovernmental Panel on Climate Change (IPCC) has published intentionally misleading data.

The video below shows Verdier reading the letter, with the caption stating: ‘Philippe Verdier, journalist, weatherman. Fired by France Television one month before COP 21 [The Paris Climate Change Summit]’.

Verdier has previously commented on how he believes he was suspended because the government wanted to hush up any criticism of climate change in the run-up to the summit:

“Making these revelations in the book, which I absolutely have the right to do, can pose problems for my employer given that the government (which funds France 2) is organising COP. In fact as soon as you a slightly different discourse on this subject, you are branded a climate sceptic.”

Strange when you think that after the last 29 ice ages that science claims to have occurred there has been very significant Global Warming.

Since the self same grouping of science alarmists, in order to perpetuate their income and various grants, presumably, had been warning of an impending ice age in the 1970s and early 1980s – were there any plausible facts or undisputed evidence to support the IPCC reports fanciful claims and alarmism, perhaps we should today be thanking mankind for his prodigious power in changing climate to avoid the ice age we were threatened with!

We are threatened by these same scientists with the extinction of polar bears – fancy that! When I was a child we were taught that the polar bear was threatened as there were only between 7 & 10,000 on the planet – their extinction is no closer now than then as estimates claim there are now around 30,000 in the wild alone!

To further personalise the issue I live a few 100 yard north of the Severn Estuary and Global Warming has altered this area hugely as during the last ice age it was ONE MILE deep in ice, Climate Change clearly has some merits ;-))

We believe the information gathered on this site can act to bring the truth, regarding the dishonesty of the claimed benefits of Wind Turbines (WT) to the front of people’s minds as they are regularly taxed, in a hidden tax, on their energy bills to fund these politically correct and fundamentally all but useless monstrosities.

I wish to object in the strongest terms possible to the planning application reference number 131343.

 

The application and its supportive documentation are totally and utterly flawed and I will go through each document in turn.

Section 3. Description of proposal.

 

The proposed Tozzi Nord Victory 24-60 60kW wind turbines can have a hub height of 22m or 30m according to the Italian manufacturer’s data however this is different to Life Long Energy’s own web site which states that the hub height is 24m.

Section 12. Assessment of flood risk.

 

The proposal will increase the flood risk as the applicants, Total Reclaims Ltd have destroyed the communal surface water drainage infrastructure and this has already caused problems for us and others with surface flooding, continuous wash in of demolition and concrete crushing debris, polythene membrane and other litter and large rain associated soil erosion to such an extent that our western land boundary and at least one memorial tree has roots now in thin air!

The proposed disposal of surface water to a main sewer is most interesting, as only two, known to be working, 4 inch main sewer pipes leave the area.

We have spent six years clearing demolition rubble from them so that we can use them and not inflict problems for those companies downstream in the technical park.

The 4 inch outgoing system from the Heritage Centre has been successfully tested and proved to flow downstream as far as the central water tower, therefore eliminating any future problems for other current users of the site communal system.

The entire former aircraft apron site drops over 10 feet from end to end and water gathers at the proposed turbine 1 site because Total Reclaims destroyed the communal surface water drainage infrastructure.

 

Section 13. Biodiversity.

 

  1. Protected species

The answers to questions a) and b) filled in by Mr Allsop are incorrect.

The correct answer to a) and b) is yes, on land adjacent to or near the proposed development.

 

There are at least three known protected species and possibly more.

 

Bee Orchids – as photographed for Cleethorpes Camera Club Photo Competition 2012 and in 2014 we had 21 plants in flower in our camping area with care advice being taken from Steve Jack the Lincolnshire Wolds Countryside Service Manager.

There are many other unidentified species awaiting confirmation of identification by the relevant authorities.

I was very concerned about the situation and had correspondence with English Heritage and the Lincolnshire Conservation Trust in August 2012.

It is an important brown hare breeding ground with partridge, lapwing and skylark ground nesting areas.

Barn owls, kestrels, sparrow hawks and buzzards use the area for hunting, we have resident stoats and weasels and it is an annual breeding ground for swifts, swallows, pied wagtails and fieldfare.

The silver birch trees in particular attracting large quantities of ladybirds which then attract goldfinches, etc.

In winter, swans and geese use the area for transit flight from the lobby ponds at the bottom of Ash Hill en route to the Humber estuary.

One of the biggest roost colonies for rook, crow and jackdaw is in the wood behind the proposed turbine 1 at TF199961.

This wood originally stretched right across the land that RAF Binbrook airfield was built on, so may well have been a traditional breeding area for centuries.

They gather every evening from all over a wide area of the wolds taking up to half an hour to fly in. The concentration in the breeding season exceeds well over 1000 birds.

At night we have fox and other nocturnal animals.

It is truly a special, peaceful, tranquil and magnificent place within the AONB and must be protected at all costs.

 

Section 14. Existing use.

 

The land was subject to a planning tribunal against Winchester Marine Ltd and restrictions were placed on it at that time.

It has, I believe, only planning for open storage use with height restrictions and limited traffic movement with vehicle logging.

Now that the concrete apron area has been totally destroyed by the applicant, doesn’t it have to revert back to agricultural land under the Chrichel Down rules?

 

Section 15. Tree and hedges.

 

There are trees adjacent to the development and there is a boundary thorn hedge planted on the bund at great expense, in compliance with the planning tribunal by Winchester Marine Ltd and it attracts lots of wildlife especially the buzzards, sparrow hawks and kestrels whilst hunting their prey.

We have planted many more memorial trees in the adjacent Bomber Command Memorial Park to supplement other memorial trees already planted adjacent to the proposed turbine 1 site.

 

Section 23. Hazardous substances.

 

The answer is yes. Hazardous waste will be involved in the proposal.

The turbine pitch system is hydraulic and waste hydraulic oil is a hazardous substance.

Wind turbulence which is a hazardous waste to anyone downwind and GRP blade shedding of any size can be lethal.

Our Air Cadet, veteran camping area and visitor picnic area is a matter of yards away from proposed turbine 2 and therefore the hazardous wind turbulence, horrendous noise, strobe effect and the total loss of amenity to our visitors would be indescribable.

It is very clear to me, that you could fit at least another 4 turbines in between the initial 2 should, god forbid, planning permission be granted and would open the door to further energy generation applications on the site, which could involve practically anything.

 

Drawing – Wind Turbine Elevations.

 

The turbine drawing shows a hub height of 22 metres however the drawing narrative clearly states it is 30 metres with a blade tip height of 42.4 metres.

 

Site Layout – Block Plan.

 

The proposed on site delivery route of materials runs along what is left of our western land boundary which will cause more damage to the existing damage already done by the applicant. He has already destroyed our communal storm drainage infrastructure, destroyed our western land boundary and covered our Bomber Command Memorial Park infrastructure and memorial trees with concrete dust, polythene membrane, litter, etc and the continuing HGV traffic removing the last of the crushed hardcore and the bringing back to site of soil, etc, of unknown origin or toxicity, continues to wash debris down into our southern end surface water soak away system, continuously blocking up the first main gulley.

 

Amended acoustic assessment.

 

As a former member of the Nottingham Society of Engineers and having worked for Plessey, GEC and Marconi, I am quite familiar with investigative research in regard to engineering, international and global standards compliance, computer modelling, calibration methodology and the bringing of products to market and the subsequent integration into the field.

It is my professional opinion that the amended acoustic assessment written by Life Long Energy Ltd is not only unprofessional but not worth the paper it is written on.

They might have learnt how to cut and paste within a document but clearly have yet to master a spelling checker.

 

I have attached documentation to support this.

I’ll start in Italy.

As you can read on the Tozzi Nord Victory 24-60 sales brochure from Italy:-

 

Tozzi Nord is the first Italian manufacturer of small wind turbines to have

Its TN535 turbine (10 kW) certified by an accredited body and to install

its product even in the UK. The same path is now being followed for the Victory 24-60 (60 kW).

Designed to meet the IEC61400-1 standard, the certification process for this turbine is currently underway (certification measurement performed by Windtest Grevenbroich gmbh).

This process also includes certification of the power curve and noise emissions, thus confirming the turbine’s qualitative excellence and guaranteeing the customer a secure investment.

 

Now we follow the trail to WTG’s wind turbine test facility in Germany.

There is no reference anywhere on their web site to this turbine being under test or having been tested for power curve or noise emissions but I emailed them to see if it was awaiting erection at their small turbine test site 8 but have not received a reply back so far.

It could be that it was tested at another site in Italy but you would have thought there would be a reference to it somewhere for WTG company publicity reasons unless their report, if any has been produced, was detrimental.

 

Next we travel back to the UK and Life Long Energy and several of their acoustic assessments in support of planning applications around the UK.

 

One: – Total Reclaims Ltd, Brookenby

Two: – New England Quarry, Plymouth

Three: – Burton Pidsea, Hull

 

Firstly, the use of ETSU-R97 does not comply with EU law or with UK regulations on environmental impact assessment.

It is considered by Dick Bowdler of New Acoustics and Mike Stigwood of MAS Environmental amongst many other experts, to be fundamentally flawed and very likely allowing situations to occur that are not only hazardous to health but likely to lead to major litigation in the future.

 

The three Life Long Energy acoustic assessments’ I have used here, are all for the Tozzi Nord Victory 24-60 60kW wind turbines but are not consistent with each other.

 

The Binbrook and New England Quarry 10 m/s turbine sound power levels in normal operation mode (table 3.1) and octave sound power data (table 3.2) appear identical, despite a hub height difference between the two turbine sites planned.

Binbrook’s hub is 22m, whilst New England Quarry’s is 30m.

Identical spelling mistakes appear in both documents, suggesting a cut and paste operation from another source.

We are told that the overall guaranteed sound power levels at various wind speeds and hub heights come from a document allegedly produced by WTG Germany for Tozzi Nord but this document and data cannot be verified, as we have no copy of it.

 

Next we go to Burton Pidsea.

An identical 30m mast height as per New England Quarry but suddenly the 10 m/s sound power levels for the turbines in normal operation mode, table 3.1 has been removed but the spelling mistakes are still there.

Why is this?

 

Now the octave sound power data (now table 3.1) is not only louder across the spectrum and a new low frequency band of 31.5 hertz added but we no longer know if the data is for 10 m/s.

 

It could be for 1 m/s for all we know at this stage!

We do know however that the nearest NSR is only 250 metres away and there are plans for a third turbine very close to the site and suddenly the operation of the third turbine could potentially result in cumulative noise!

 

Really? I am surprised.

Of course the modelling using ETSU-R-97 passes with flying colours, so let us dig a little deeper!

Luckily for us, each of the acoustic assessments has the WindFarm Software Acoustic Run Data at the back.

 

For clarity, the revision number would appear to be the number of times the model was changed before the noise results became ‘acceptable’.

 

New England Quarry – 10 revisions

Binbrook – 63 revisions

Burton Pidsea – 18 revisions rising to 22 when the third possible turbine was added into the equation.

 

By comparing the run time data for all three assessments, you can see that by altering the following parameters in the model, you can lower the noise results.

Of course, knowing the ‘alleged’ noise levels at 10 m/s is pretty useless to us when the turbine can operate to twice that speed (20 m/s) before ‘allegedly’ and hopefully cutting out.

 

Back to the Burton Pidsea assessment.

 

5.5 Model Qualifications

 

The accuracy of the ISO 9613-2 method is limited to approximately +/- 3 dB. Due to the uncertainty associated with noise modelling, it is important to use conservative input data and parameters for the model. The noise model and input data used for this analysis contain the following conservative input data:

  • Turbine sound power level of 94.5 dB (A)
  • A ground factor of 0.9 when the majority of the land is porous
  • Modelling favourable downwind propagation condition for all turbine sites simultaneously

 

Given the conservativeness of the noise model inputs and parameters, the predicted noise levels at the receptors should be somewhat ‘worst case’ compared to the long term average noise levels that are actually encountered. However, there may be certain condition under which the noise level at a receptor is higher than, or is perceived to be higher than, what is predicted. These conditions could include periods of high atmospheric stability and high wind shear, leading to low background noise levels at ground level. Temperature inversions may also periodically increase the sound pressure level at a receptor.

 

Now we are getting closer to the truth but are still not told what the highest turbine sound power level is at 20 m/s cut out speed or 43 rpm!

 

  • Turbine sound power level of 94.5 dB (A) per turbine!

 

This figure, of course, is only mentioned in the Binbrook acoustic assessment in our table 3.1 where it would appear to be the alleged sound power level for a low wind speed of 7.5-8.5 m/s.

 

All of this noise modelling is not only guesswork but fabrication of the results!

It is only as good as the person who wrote the computer program in the first place and we have no idea of what other parameters were fed into the model by Life Long Energy to get the results they wanted!

This is outrageous misinformation designed purely to deceive the casual reader of the document and hoodwink the planning committee’s concerned.

As far as Binbrook is concerned, the nearest main noise sensitive receptor (NSR) is not as stated in the flawed assessment but it is the RAF Binbrook Heritage Centre site and the offices of the business’s that occupy the three hangars facing the proposed sites which are only a matter of yards away from any of them.

The next nearest NSR after that, is the WLDC designated amenity land at TF197954 approximately.

There is still, rather conveniently, no mention at all of the dB(C)-weighted or dB(G)-weighted noise figures for prolonged low frequency average over distance, just the dB(A)–weighted figures.

The assessments using IEC 61-61400-11 states that low frequency noise or ‘infrasound’ is not required.

I totally disagree, as it can be both ground and airborne and easily deflected by large structures such as reinforced concrete aircraft hangars and this low frequency over distance is easily demonstrated here and even more so, since hangar one’s front was sheeted with metal cladding.

The front three hangars at Binbrook act like a parabolic sound mirror, with lower frequency sounds ricocheting off them with a Doppler Effect.

Shotgun fire, bird scarers, the testing of fireworks by Chestnut Trading, the cattle herd at Stainton le Vale, British motorcycles on Wednesday evening’s Bike Night en route to Willingham Woods, the heavy four stroke scramble motorcycles using the course near Caistor and even the Avro Vulcan taking off at the RAF Waddington Air Show are currently clearly audible over the background wind and tree noise.

The assessment does not mention anything about the Doppler Effect that will occur between the two turbines. There isn’t a way of synchronizing them together, so it will be akin to the twin engine Luftwaffe aircraft of WWII, always out of synchronization and creating additional harmonic noise at a distance point between them.

 

Planning guidance 2.1 National Policy Framework

 

The national policy framework clearly states that planners should identify and protect areas of tranquillity which have remained relatively undisturbed by noise and are prized for their recreational and amenity value for this reason.

 

The incorrect NSR location and the incorrect noise level data hiding the turbine ‘hum’ component, low frequency noise, etc, completely invalidate the acoustic assessment which is only a predicted assumption anyway.

 

Binbrook Pre Public Consultation.

 

Binbrook! We are the village of Brookenby and have been for nearly 25 years!

Yet again, what is the correct hub and blade height?

What site wishes to reduce its energy bills?

The applicant has no energy bills, as he has no business in operation on the land.

This again, is outrageous misinformation designed purely to deceive the casual reader of the document and hoodwink the planning committee.

 

Landscape and visual impact assessment – Life Long Energy Limited.

 

This assessment is just a rehash of the original and no-one even bothered to check it before submitting it to planning again.

At 4.6.2 table 5 Sensitivity of visual receptors, it clearly states that visitors to heritage sites are high zone 1 sensitivity.

At 4.6.2 table 6 the proposal becomes a very large magnitude of impact and will dominate the view.

At 4.6.2 table 7 using the decision matrix, the overall significance of visual effect is large and major.

 

It still refers to an associated substation at 6.2.1 necessary for the original proposed turbine model and we still have the fictional 25 year decommissioning phase at 6.4.

It is useless doing a desk based analysis because it doesn’t take into account recent local changes in the landscape, such as the removal of the tree screen around the former RAF Binbrook officers mess site and the removal of part of the mature tree screen to the east of York Road in Brookenby or provide knowledge of the historic nature of the site and the special place it holds in the hearts and minds of generations of families across the world.

Australian visitor families do not travel 12,000 miles for fun!

 

In section 8.0, it refers to existing wind energy developments.

The two at North Wold Farm, Thoresway which we knew nothing about until the first one appeared out of the fog one day and to which we would have submitted a planning objection and two at Tetney (incorrect NGR) which I believe have never been used due to the developer building them without plans or agreement for the power distribution from them!

Having spent a great many hours downloading and printing the view images, the wire frame images and the photomontage’s, I have been unable to replicate what they are trying to convince me of apart from viewpoint 16 (Swinhope Road and York Road, Brookenby).

The image clearly shows the first house in York Road facing towards my house in Salisbury Avenue.

Hubs nil, blades nil. Correct. As the photomontage image shown below is pointing in the opposite direction to the proposed turbine sites by at least 90 degrees!

All of the images are conveniently taken to the applicant’s advantage at 1100 on the 4 November 2014, so perhaps the images were damaged as they passed through the space-time continuum because you cannot be in 21 different locations at the same time!

 

Heritage and Conservation Impact Assessment. – Life Long Energy Limited

 

The whole area is of major archaeological importance. Not only for the recent RAF history from 1940-1988 but throughout the ages.

There are ancient looking earthworks at TF202947 which to my knowledge have not been investigated which could be related to a ford at Orford or as far back as the Iron Age.

There appear to be grave like cuts in the field at TF204946 which have only been spotted this winter and although we have heard of an Anglo Saxon site on the airfield having been investigated quite a few years ago, we can trace no record or any results so far.

In our search for RAF Binbrook artefacts, we have covered a wide area with metal detectors but only to a very shallow depth, although we have a number of deep ferrous targets / objects to investigate further.

The only possibly non RAF related artefact found so far from a very shallow depth, has been a bronze / brass hinge off a door or wooden chest.

It is inconceivable that there is not more to be found on a high strategic point in the landscape with a permanent spring fed water source in the valley.

I have attached a newly acquired aerial photograph of RAF Binbrook taken in the 1960’s.

As you can see in the fields to the east of Swinhope Road, Brookenby, there are marks in the fields.

The one marked ‘Roman’ was found a few years ago by me and I alerted the metal detecting club who told the relevant authorities.

I myself have found a knife blade on the surface and non local stone after ploughing and Roman artefacts have been coming out of the field since then.

I believe a proper field survey was carried out this year.

The photograph also shows something in the field opposite my house in Salisbury Avenue, Brookenby.

I have previously found old non local stone on the northern field edge bank which is higher that the present field cultivated level.

This edge bank leads down to the current stream which I believe was a lot deeper and navigable by small craft centuries ago to the sea outlet at Tetney High Sands.

There is certainly something strange and out of landscape context at TF211955 which warrants further investigation, as it is very close to Hoe Hill long barrow.

There are many areas of archaeological interest across the area which may well yet become the future scheduled monuments, etc.

Just because it isn’t on an ordnance survey map, a computer system or in a planning assessment, mean it isn’t there!

I can take you to a number of sites shown as a bit of woodland on the ordnance survey maps but when you are physically there, the landscape is much more.

An example is the tiny bit of woodland at TF226967. When you get inside it, you find that it is a large pit where iron ore has been extracted from the chalk and flint.

 

Design and access statement – Life Long Energy Limited.

 

  1. Introduction.

 

The proposed turbine sites are within an area with planning for storage on concrete (now removed by the applicant as well as the area’s service infrastructure), with severe limitations on it, as per the Winchester Marine planning tribunal and any remaining infrastructure to it, does not integrate with the Binbrook Technical Park without crossing land which is NOT owned by the applicant.

The land owner does not currently have any electrical energy requirements or reliance on fossil fuels on the land.

The other businesses within the Binbrook Technical Park seem to already have various choices of energy supply and I am led to believe the G4 Park is totally self sufficient.

 

  1. Proposal.

 

There is no documentation to support what they plan to do with the electricity produced and how they plan to integrate the supply into the national grid system or to the Binbrook Technical Park.

It is all pure speculation and a continuous stream of falsehood’s designed to hoodwink the planning committee.

 

  1. Consultation.

 

Mr Ian Elliot’s comments refer to our land and our projects not the applicants and have no bearing on this application.

The applicant’s land which is strewn with litter, rubbish and overgrown grass, has not been cut since his ownership and has been the subject of complaints to Environmental Health.

We have even tidied some of it up to stop the ingress of more debris onto our camping and picnic area and worked around the Skylark breeding season.

The RAF Binbrook Heritage Centre and Winchester Marine Ltd have spent a great deal of time, effort and money improving the area from the wasteland and dumping ground that it was back in the 1990’s as part of Aviation Heritage Lincolnshire and Lincolnshire County Council’s efforts to expand the tourism portfolio within the County, the AONB and West Lindsey in particular.

The specimen memorial trees in the Bomber Command Memorial Park have been sourced from Northern Ireland, Orkney, Brazil and Poland and in time will form a magnificent wildlife sanctuary and place of solace and tranquillity for those visitors from across the world seeking reflection and remembrance.

The species of conifers in particular have been chosen for their different texture, feel and fragrance so that blind or partially sighted visitors can experience a sensory trail when they have grown a bit.

This year 2015 is a special anniversary year.

It is the 70th anniversary of Operation Manna when aircraft from RAF Binbrook took part in dropping food supplies to the starving Dutch people and of course we have the 70th anniversary of the liberation of the Dutch people and the ending of hostilities in Europe.

To commemorate this, we have planted an additional 400 daffodils around the camping and picnic area and 362 white tulips on our northern boundary of the Bomber Command Memorial Park.

 

  1. Design.

 

To see the proposed hideous turbines being installed and to see just how they will integrate visually into the AONB, I suggest you watch this:-

They will really blend into the background in an AONB, won’t they?

The off white colour and bright blue company logo will not blend into the landscape but if the masts were painted with canary yellow stripes, at least the crew of the international space station could use them for navigation.

They will be visible for miles as another hideous eyesore and there is no reference to future painting maintenance schedules if any has been taken into account, over the proposed and I believe fictional, 25 year life cycle.

The concrete foundations are a massive structure and would have to be poured in one go. This entails a large amount of heavy vehicle movements bringing structure components to each site.

There is no water on site to support any part of the construction phase.

To prevent lightning strikes all of the earthing infrastructure will have to be re-installed as the original RAF infrastructure was destroyed by the applicant.

I am deeply concerned about ice build up and subsequent ice throw from the turbine blades in winter especially spinning at up to 43 rpm.

They don’t have de-icing boot systems like aircraft do and people at the Heritage Centre could be seriously injured without warning with the temperature having been down to -16.5C in recent years.

The proposed turbine sites do not have any service infrastructure, fire fighting capabilities, security infrastructure, designated safety zones or disaster recovery and contingency plans.

We will not tolerate any more dust, debris, litter, food waste, hazardous waste, etc from operations on their land blowing onto our Bomber Command Memorial Park or camping area.  

The bringing back to their site of soil, etc, of unknown origin or toxicity may well have an effect on our planned drinking water borehole.

 

4.2 Use of Proposal.

 

The applicant’s have failed to provide any support documentation on HOW they plan to integrate into the existing infrastructure of the Binbrook Technical Park and the National Grid Network.

 

Transport statement – Life long Energy Limited.

 

The maps showing the proposed delivery route of materials and equipment to site does now show the traffic coming past Binbrook village school, however the route chosen from Market Rasen, via Tealby and Bully Hill is totally unsuitable for large, heavy goods vehicles. The road from Bully Hill to Kirmond le Mire in particular is already very badly damaged along one entire edge and needs a total rebuild.

 

Impact on the landscape.

 

There will be a major impact on the AONB and it will destroy the peaceful, reflective solitude of the Bomber Command Memorial Park, our magnificent views across to the Yorkshire Wolds, the Humber estuary and our wonderful dark night skies.

These are enjoyed by visitors from across the world.

 

Shadow flicker.

 

This will greatly affect the visitors to the Heritage Centre and particularly people such as me, who are blind in one eye from birth and very susceptible to strobe effect.

 

Aviation and radar.

 

The proposed turbine site is directly in line with aircraft taking off from Humberside airport and others going in to land at RAF Coningsby and RAF Waddington and will no doubt interfere with Eastern radar at Claxby.

RAF Tucano aircraft from RAF Leeming and others involved with low level training flights from RAF Cranwell regularly fly low level sorties across the site and other RAF aircraft fly over regularly to pay their respects to the 460 Squadron RAAF memorial site.

It is used by all types of aircraft en route to North Coates flying club and is a visual flight rules (VFR) navigation aid to the Lincolnshire Air Ambulance en route to accidents on the A180 and when taking casualties to Grimsby hospital.

Bond helicopters from Humberside airport use the air space for flight testing of their helicopters and transit flights to the southern North Sea oil and gas platforms.

A variety of aircraft use the airspace to practice display routines, including solo Red Arrows, a private Supermarine Spitfire and Me109 and an aerobatic pilot whose display routine is outstanding.

Aircraft en route to the Cleethorpes Air Show use the hangars as a navigation reference and we have been in contact with them in regard to staging our own air show at Binbrook in the future.

The proposed wind turbines would have to have anti collision beacons on them which would be a breach of WLDC’s own dark skies policy.

It is against my human rights as a disabled person not to be able to enjoy aviation related activities at the Heritage Centre and I shall seek further advice from the European Court of Human Rights should this planning application be granted.

 

 

Conclusion.

 

Over 14,000 wind turbines from Alaska to Hawaii have been abandoned by companies which have either gone into liquidation or just left them because of rising maintenance costs, upgrade or replacement costs and lower feed in tariffs.

Who will decommission the proposed sites and associated national grid infrastructure if the company responsible for building and operating them is no longer in existence and more importantly, who will pay for the alleged cleanup operation in the alleged 25 years time.

The composite materials that the turbine blades are made from, is non-recyclable, so where is the designated land fill site going to be to accommodate all of the blades from all of the turbines in Lincolnshire already approved?

Worn out and damaged blades are already stacked up all over Europe awaiting disposal.

A friend of mine is a director of the Humber Gateway project where Siemens are currently fitting a 3Mw turbine off shore a week. This small scale ‘get rich’ scheme is not needed whatsoever, especially in the Lincolnshire AONB.

The proposed development will have a devastating impact on the landscape, wildlife and amenity of the AONB.

More and more visitors from across the world are discovering the peace, tranquillity, beautiful views, dark skies and undeveloped quality of the countryside of the Lincolnshire Wolds AONB.

This proposal will decimate the hard work put into the tourism portfolio for the area and the local business infrastructure that supports it.

The camp sites, the caravan sites, the B&B’s, the holiday cottages, the pubs, the restaurants, the guest houses, the museums, tourist attractions and the local market town economy.

The cumulative effect of passing these proposals within the AONB will be major and destroy what has already been achieved.

I have written to the prime ministers of the UK, Canada, Australia and New Zealand and to President Obama in the USA regarding this matter as the last American killed whilst flying from RAF Binbrook, Captain William Schaffner was sadly lost without trace in the North Sea in 1970.

We hold one of the finest collections of RAF artefacts, photographs, aircraft drawings including the entire English Electric Company’s Lightning drawing archive and reference and engineering books, some of which are totally unique.

We collaborate with other museums worldwide and provide engineering parts support for the Royal Australian Navy’s (RAN) Fairey Firefly and Ed Kurdziel’s Fairey Firefly WB518 in the USA.

We also provide parts and engineering drawing support for various English Electric Lightning projects including the Anglo American Lightning Organisations T5 XS422 return to flight status in Mississippi and Supermarine Spitfire projects such as the rebuild of BL246 in both the UK and USA.

 

We have had discussions with organisers of the Duke of Edinburgh’s Award Scheme, Lincolnshire Young Offenders Scheme, North East Lincolnshire’s Young Offenders Scheme and Morton Hall and we hope to get prisoners from North Sea Camp in the future but a simple planning enquiry from us in support of this took from 15/3/13 to 12/10/13 to get a reply from the WLDC planning dept.

 

My great grandfather C S Carter was one of the founder members in 1884 of the Louth Naturalists’ Antiquarian and Literary Society which continues to this day as Louth Museum.

The work they did to discover the beautiful and rare geological and ecological things in the Lincolnshire Wolds was the foundation stone of the current AONB status.

I will fight to continue the preservation of what he and his Victorian friends started.

I request that the planning proposal be refused and that the unique Cold War iconic 11 Squadron line building (weighbridge) at TF 197956, possibly the only one of its type still left in existence and of international, if not worldwide importance, be afforded some form of listed protection.

I would also request that the Heritage Centre land and the grass and tree filled land either side of us be changed to D1 (Museum) status to protect it and the 5 Squadron maple leaf crest on hangar 2 which has been there for fifty years this year, be afforded some form of protection along with the memorial trees in front of the hangar itself if they haven’t already got it.

(PS-37 Yet Another ACCIDENT within sight of Hanley Hill)

It is of note that there is yet another vehicle with its front end smashed in, an orange car, abandoned in the ditch near Hanley Farm shop!

I have not heard the extent of injury of those involved as yet but will add the detail if I find out!

Further facts have come to hand:
I am told that a car had broken down and was in Hanley public lay-by – a friend called from Lydney to help arrived and indicated intent to turn into Chepstow end of Lay-by and stopped facing oncoming traffic within a few seconds a car drove into the back of his car and shortly after that the orange car drove into the back of the two static cars!

The 3 car crash happened just before 17:00hrs., Police attended and all 3 vehicles were removed by 20:30hrs., fortunately, I am told, with no consequential injuries.

There have been 2 fatalities and various very serious injuries within view of Hanley Hill in two fatal accidents so far this year and a total of 5 fatalities within sight of Hanley Hill in recent years, plus of course numerous other accidents on this particularly dangerous stretch of road with its multiple junctions and the particularly dangerous Hanley layby which itself has multiple junctions and much increased traffic due to commercialisation as a multiple occupancy office venue, a farm shop and a single dwelling converted to multiple occupancy!

It is legitimate, since the primary cause of accidents according to The MoT/DVLA, is distraction – just imagine how we can expect the fatality and serious injury rate is likely to escalate as traffic levels increase with the 5,000 new houses already with planning approval granted from Lydney to Chepstow if the gross iresponsibility of granting and installing a wind turbine 337 feet above the River Severn on Hanley Hill is granted next to the A48 – the most dangerous road in Europe in terms of fatalities per mile travelled.

There was also an accident nearby earlier in the week – sadly as yet I have no further details.

The cost to the public purse of these accidents likely to be caused by the distraction of a wind turbine pale into insignificance relative to the subsidies payable on a wind turbine or any potential theoretical benefits and thus I would contend that such a scheme/scam would only be undertaken by those with an utter disregard for the area and the lives of others.
